Florida’s TNC statute governs Lyft coverage. Under Florida Statute § 627.748, a Lyft driver (or Lyft on behalf of the driver) must maintain specific insurance coverage based on the driver’s status. When the driver is logged off the app, the driver’s personal auto policy applies and Lyft provides no additional coverage. When the driver is logged in but not yet dispatched, the statute requires at least $50,000 for bodily injury per person, $100,000 per incident, and $25,000 for property damage, plus PIP and uninsured motorist coverage. When a ride has been accepted or a passenger is in the vehicle, Lyft’s coverage rises to at least $1 million in combined liability protection. Personal auto policies often exclude coverage during any rideshare activity, which makes identifying the correct tier critical to a recovery.
Two-year filing deadline. Under Florida Statute § 95.11, as amended by House Bill 837 in 2023, negligence claims must be filed within two years of the injury. Missing this deadline ordinarily bars the claim regardless of its merit.
Modified comparative negligence. Under Florida Statute § 768.81, a plaintiff found more than 50% at fault recovers nothing.
